Aura High Performance Terms and Conditions
These Terms and Conditions (“Agreement”) govern the use of services provided by **Aura High Performance** (“we,” “us,” or “our”). By enrolling in our programs, purchasing memberships, or using our website, you (“member,” “you,” or “your”) agree to be bound by these terms. Please read them carefully.
1. Membership Plans
Aura High Performance offers **Bronze, Silver, and Gold** membership plans, each with specific benefits as outlined on our website or promotional materials.
– **Bronze Membership**: Includes limited access to training sessions, discounts on group skates, and select merchandise.
– **Silver Membership**: Includes all Bronze benefits, with more access to training sessions and discounts on private coaching.
– **Gold Membership**: Includes all Silver benefits, with unlimited access to all training, priority booking for events, and exclusive perks.
1.1 Membership Eligibility
**Everyone is eligible** to join the Aura High Performance membership. However, priority access to specific programs and events is granted based on meeting the requirements of those particular programs. The eligibility criteria for each specific program will be outlined when the program is announced.
1.2 Membership Fees
All membership fees are outlined during sign-up and may vary depending on the membership level selected. Fees are non-refundable unless otherwise stated in this agreement.
– **Payment**: Membership fees must be paid in full at the time of enrollment or according to the payment schedule offered during sign-up.
– **Renewals**: Memberships may automatically renew based on the terms selected at sign-up. You may opt out of automatic renewals by contacting us in advance.
2. Booking and Cancellations
2.1 Training Sessions, Group Skates, and Camps
– **Booking**: Sessions and camps are subject to availability. Priority booking is given to Gold and Silver members who meet the eligibility requirements of specific programs or events.
– **Cancellations by Member**: Cancellations must be made at least 48 hours before the scheduled session. Failure to do so may result in the forfeiture of the session or applicable fees.
– **Cancellations by Aura High Performance**: We reserve the right to cancel or reschedule sessions due to unforeseen circumstances, including weather or facility issues. In such cases, you will be given the option to reschedule or receive a credit.
3. Private Sessions
Private coaching sessions are available for 1-4 skaters. Sessions must be scheduled in advance and are subject to availability.
– **Cancellations**: Members must cancel at least 48 hours in advance to avoid forfeiting the session fee.
– **Refunds**: Private session fees are non-refundable unless canceled by Aura High Performance.
4. Merchandise
Members receive discounts on merchandise based on their membership tier. All sales are final unless the product is defective. In the event of a defect, you may return the item for an exchange or store credit.
5. Code of Conduct
All members are expected to behave respectfully toward staff, coaches, and other participants. Unsportsmanlike behavior, harassment, or misuse of the facilities may result in the suspension or termination of membership without a refund.
6. Health and Safety
6.1 Assumption of Risk
Participation in hockey training and related activities involves inherent risks, including the risk of injury. By participating, you acknowledge and accept these risks. Aura High Performance is not liable for injuries or accidents that occur during training, camps, or private sessions.
6.2 Medical Disclaimer
It is your responsibility to consult with a physician before beginning any training program. By enrolling in Aura High Performance’s programs, you confirm that you are physically fit to participate in the activities.
7. Liability Waiver
By enrolling in Aura High Performance programs, you agree to waive and release Aura High Performance, its staff, coaches, and affiliates from any and all claims, liabilities, or damages arising from your participation in training sessions, camps, or events.
8. Intellectual Property
All content, logos, and materials provided by Aura High Performance are the intellectual property of Aura High Performance and may not be used, copied, or distributed without our express written permission.
9. Termination and Suspension of Membership
Aura High Performance reserves the right to terminate or suspend your membership for violation of these Terms and Conditions or inappropriate conduct. No refunds will be issued in the case of termination due to misconduct.
10. Amendments
Aura High Performance reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to members via email or through the website. Continued use of our services after any amendments constitutes acceptance of the revised terms.
11. Governing Law
These Terms and Conditions are governed by the laws of **Ontario**, and any disputes arising under this agreement shall be resolved in the courts of **Ontario**.
